General conditions and definitions
These Terms and Conditions apply to all guests of Logies op Dreef - Engweg 20 - 3972 JH Driebergen.
Where you read "tenant(s)" in these terms and conditions, you may also read "guest(s)" or "user(s)."
Tenant: the person who rents the guesthouse from the owner for a specific time and has paid the agreed rent to the owner.
Landlord: owner who rents the guest house to the tenant.
Michiel Nouwens is the manager and private owner of Logies op Dreef. The owner/manager can be replaced.
Rental Agreement: agreement between Tenant and Owner regarding the rental of the Guest House.
Owner: the owner of the guesthouse or his representative (key manager) who provides the guesthouse to the tenant.
Rental price: price per day. Cleaning fee and tourist tax are added to the rental price.
Down payment: the portion of the rental price that the tenant owes the owner upon booking.
Deposit: the amount the renter pays in advance to the owner for any additional expenses, damage or loss for which the renter is responsible.
Arrival and departure times: the times agreed upon between tenant and owner.
Article 2.
Establishment of lease agreement.
The rental agreement is established after the tenant completes the booking on the owner's website, reads and confirms the terms and conditions. The owner must confirm full payment to the renter.
Article 3.
Payment Terms
After a booking by the tenant on the owner's website, the full rental price is paid through the online payment service Mollie.
Mollie then makes sure we receive the amount and sends us a confirmation of the payment. The landlord receives from Logies op Dreef by email a confirmation of the booking and payment. Optionally, on request a receipt (customer receipt) in the name of the tenant can be issued without VAT.
With years of knowledge in the payment market, Mollie guarantees the safest possible handling of the transaction and offers a 'secure' connection for this purpose. Mollie is certified by Currence to offer iDEAL. Besides iDeal you can also pay with Mollie by credit card or PayPal.
Only with a Sepa transfer, payment of 100% must be credited to the bank account specified by the owner to the tenant within two days of booking by the tenant on the owner's website. With all other means of payment, the full amount will be transferred at once on the booking date. If the payment is not credited within this deadline, the rental agreement is deemed not to have been concluded. The full rental price as well as any deposit and cleaning fee must be transferred to the owner's bank account. If this is not met, the right to rent the guest house expires, subject to the provisions of Article 9.
Article 4.
Cost
If charges apply in addition to the rent then this will be listed on the owner's website. Tenant will pay these charges in the same manner as the rent according to the provisions of Article 3.
Article 5.
Deposit
The owner is entitled to charge a deposit of 150 Euros to the tenant. The deposit must be paid, in advance, to the owner. The deposit will be refunded by the owner to the tenant's bank account within two weeks after the agreed period of stay. This is subject to deduction of any costs of damage, defects and/or loss or disproportionate consumption of energy.
Article 6.
Obligations of the owner
The owner shall ensure that the guest house is made available to the tenant at the agreed time of arrival in a well-kept condition and in accordance with the booking confirmation.
Article 7.
Obligations of the tenant
Accommodation in the guesthouse is allowed up to the number of persons (in this case 2) listed on the owner's website. Only the named persons specified by the tenant at the time of booking are entitled to stay overnight in the guesthouse. Tenant is responsible for these persons at all times. The guesthouse is expressly not suitable for young children under 12 years of age. If tenant does bring one child, he/she is fully responsible for the safety of that child. More than one child is not allowed.
If the above provision is violated, the rental agreement will be terminated with immediate effect and the tenant will no longer have access to the guesthouse. Tenant shall remain liable for the full rental price and the owner shall be entitled to rent the guesthouse directly to another party.
It is not allowed to open locked doors and cabinets (private). When leaving the guesthouse, even for a short time, the guesthouse must be completely locked. Windows and doors closed and front door locked. In case of damage, theft or loss due to non-compliance, the tenant will be held liable for the entire damage.
Smoking-Smoking indoors is not allowed-Smoking in the bedrooms is not allowed-By violation of this, the deposit will not be refunded due to professional cleaning costs.-In and around the guesthouse is not allowed to use (soft) drugs.
No smoking is allowed in the guesthouse. In case of fire due to negligence, the tenant will be held liable for damages.
Pets-Pets can unfortunately not be brought, this is for hygiene reasons.
Normal use of energy and water is of course included. If it appears that there is disproportionate use then costs will be charged to the tenant.
The tenant is required to provide access to the guest house for necessary repairs and maintenance.
Article 8.
Arrival and departure from the guesthouse
Arrival and departure will take place on the arrival and departure dates mentioned in the booking confirmation. Time of arrival of the tenant is allowed after 4 pm. Departure must take place before 11:00 am. This may be deviated from after consultation with the owner.
Upon arrival, the renter checks that the guesthouse and its inventory are complete and undamaged. If anything is missing or damaged, the tenant must report it to the owner within 24 hours of arrival. He will then do his utmost to repair it (or have it repaired) or to replace or supplement it.
The expected time of departure should be communicated by the tenant in a timely manner to the owner who will inspect the guesthouse with the tenant.
The guesthouse will be left neat and "broom clean" by the tenant at the end of the stay. Trash cans emptied and garbage in the containers downstairs. Crockery and accessories are returned clean to the cupboards. Damage, missing or defective items should be reported to the owner.
Article 9.
Cancellation or modification of the lease by the tenant
In the unlikely event that you are unable to fulfill the rental agreement entered into, you must notify the owner as soon as possible so that the vacant guesthouse can still be offered to third parties.
No changes can be made by the renter to a booking made and paid in full other than after consultation with and approval of the owner.
If a reservation is cancelled, the guest(s) will pay a fee to the owner.
-In case of cancellation of a 'Non-refundable' reservation, the cancellation fee is always 100% of the agreed price!
-For cancellation of a 'Free-cancellation' reservation and more than 14 days in advance, cancellation is free.
-For cancellation of a "Free-cancellation" reservation from 7 days or less before the arrival date, the cancellation fee is 100% of the agreed price.
-If you cancel a 'Free-cancellation' reservation between 7 and 14 days, you will receive a 50% discount coupon for your next direct reservation with us as a courtesy.
To be eligible for a refund of the amount already paid (if applicable), the cancellation must be made in writing (by e-mail) to Logies op Dreef. The refund is usually processed through Mollie within one week but may take up to two weeks.
In case of late arrival or early departure from the guesthouse, the full rental fee remains due. Cancellation fees are also due if you do not show up. (No Show)
Making an Internet booking for overnight stays falls under "leisure activities" and is therefore an exception to the Distance Selling Act. This form of service (booking overnight stays) is one of the exceptions to distance selling, for which there is no cooling-off period. Therefore, in principle, you are not entitled to a reduction of the booking fee if you cancel your stay.
Article 10
Termination or modification of lease by owner
In the following cases, the owner may terminate or modify the rental agreement:-When the tenant fails to pay the rent (on time)
-In case of force majeure, war, strike, natural disaster, extraordinary weather conditions, fire, death of owner or immediate family. All amounts paid by the renter for unexpired nights will be returned to the renter within 30 days of termination.
-For circumstances that are of such a nature that rental of the guesthouse becomes impossible such as, among others: theft of inventory, destruction of the guesthouse and unauthorized entry of persons as described in Article 7. If this is due to the tenant, amounts already paid for unexpired nights will not be returned.
-Logies op Dreef has always the right more than 48 hours prior to the earliest arrival time (16.00 hours) of the reported arrival date to withdraw the final reservation without giving any reason with refund of the amount already paid to the tenant.
-The owner is not liable for any damages suffered by the tenant as a result of the termination of the agreement.
Article 11
Liability and law
The owner assumes no liability for:-Theft, loss or damage of any kind to the tenant during or as a result of the rental of and stay in the rented guesthouse.-The failure or rendering inoperative of technical equipment in the guesthouse, temporary failure or malfunction of water and/or power supply, road and/or construction work in the vicinity of the guesthouse.-Damage or injury resulting from the use of the guesthouse including inventory, or accidents in and around the guesthouse as well as the stairwell.-The car can be parked on private property, parking is at your own risk.
The tenant is severally liable for all loss and/or damage to the rented property or its inventory, regardless of whether this is the result of acts or omissions of the tenant or third parties who are in or around the rented guesthouse with the tenant's permission. In case of improper use or improper abandonment of the rented guesthouse, the costs will be charged to the tenant. The owner will make every effort to provide correct information to the tenant but is not liable for unexpected inaccuracies and/or omissions in the information provided.
All disputes between Tenant and Owner shall be governed exclusively by the laws of the Netherlands.
Article 12
Complaints
All complaints pertaining to the use of the guest house must be immediately submitted by the tenant to the owner. The tenant shall give the owner adequate opportunity and cooperation to remedy the complaint within a reasonable time.
If the complaint cannot be satisfactorily resolved, it must be submitted by the tenant to the owner in writing, stating reasons. Complaints can be submitted up to 14 days after the end of the stay in the guesthouse.
Privacy
Information you provide in the owner's guestbook can be read by other guests. Therefore, please be careful not to entrust any personal information to the guestbook. The owner reserves the right to refuse comments at its discretion and without giving reasons.
By making a reservation you will be included in our address file. If you no longer wish to be included, please let us know via the contact option on the website. Within the framework of the Personal Data Protection Act we do not provide your personal data to third parties. We use your data to keep track of the status of your reservation and payment. Furthermore, to send you the necessary information about your stay and finally to keep you informed about certain matters. Here you can read our privacy statement.
We provide tips to make your stay in Driebergen even more enjoyable. Following these tips is done entirely at your own risk.
Liability
